Terms of Service
These terms explain the rules for accessing and using air.build and the responsibilities we have to each other.
In short: Use air.build lawfully and responsibly. Your content remains yours, but you give us the limited rights needed to operate the service. AI-assisted results can be wrong, so review and test them before relying on them. The service is provided without a promise that it will always be available or error-free.
Agreement to these terms
air.build is operated by Yellow Plus Inc. ("air.build," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the air.build website, public content, search tools, waiting-list features, and any related products or services that link to these Terms (collectively, the "Service").
By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service for a company or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.
Additional terms may apply to a particular feature, beta program, paid plan, or third-party integration. If those additional terms conflict with these Terms, the additional terms control for that feature.
Eligibility and accounts
You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you. You may not use the Service if applicable law prohibits you from doing so.
If an account becomes available, you must provide accurate information, keep your credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account except to the extent caused by our failure to use reasonable safeguards.
The Service
air.build provides information, tools, and AI-assisted experiences for people building software, including iOS apps. We may add, change, suspend, or discontinue features as the Service evolves. We will provide notice when reasonably practical if a change materially reduces a paid feature you are actively using.
Public guides, search results, examples, and other editorial material are provided for general informational purposes. They are not a substitute for official platform documentation or professional legal, security, financial, or other advice.
Acceptable use
You may not use the Service, or help anyone else use it, to:
- violate applicable law, regulation, sanctions, or the rights of another person;
- upload, generate, distribute, or facilitate unlawful, fraudulent, deceptive, harassing, hateful, sexually exploitative, or otherwise harmful material;
- infringe intellectual property, privacy, publicity, confidentiality, or other rights;
- introduce malware, probe or exploit vulnerabilities, bypass access controls or rate limits, or interfere with the Service or its users;
- scrape or access the Service through automated means outside our published interfaces or instructions;
- reverse engineer or attempt to discover non-public source code, models, systems, or underlying components, except where such a restriction is prohibited by law;
- use the Service to send spam, impersonate others, misrepresent affiliation, or collect personal information without authorization; or
- resell, sublicense, or make the Service available to third parties as your own service unless we agree in writing.
We may investigate suspected misuse and remove content or restrict access when reasonably necessary to protect the Service, our users, third parties, or the public.
Your content and our content
Your content
You retain ownership of code, text, files, prompts, feedback materials, and other content you submit to the Service ("Your Content"). You are responsible for Your Content and must have all rights needed to submit and use it.
You grant us and our service providers a non-exclusive, worldwide, royalty-free license to host, process, reproduce, transmit, display, and modify Your Content only as needed to provide, secure, maintain, and improve the Service, comply with law, and follow your instructions. This license ends when Your Content is deleted from our active systems, subject to reasonable backup, security, and legal-retention periods.
air.build content
The Service, including its design, software, text, graphics, branding, and other content provided by us or our licensors, is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your personal or internal business purposes. No other rights are granted.
AI-assisted features
Some features may use artificial intelligence to generate or transform code, text, designs, recommendations, or other output ("Output") based on material you provide ("Input"). As between you and air.build, and to the extent permitted by law, you retain rights in your Input and own any rights we may have in your Output. Similar or identical output may be generated for other users.
AI systems can produce inaccurate, incomplete, insecure, or non-unique results. You are responsible for reviewing, testing, and validating Output before using, publishing, distributing, or relying on it. You must confirm that your use of Input and Output complies with applicable law and does not violate third-party rights. Do not rely on Output for high-risk decisions where an error could cause death, personal injury, significant property damage, or the denial of a person's legal rights.
Our handling of Input, Output, and related usage information is described in our Privacy Policy and any feature-specific notice presented to you.
Feedback
If you voluntarily send ideas, suggestions, or other feedback, you allow us to use it without restriction or compensation. This does not transfer ownership of Your Content or permit us to identify you publicly without your permission.
Third-party services and content
The Service may link to or interoperate with third-party websites, platforms, models, APIs, software, and content. We do not control third-party services and are not responsible for their availability, security, content, or practices. Your use of a third-party service is governed by its own terms and policies, and you are responsible for complying with them.
Paid services
If we offer a paid feature, the price, billing period, taxes, renewal terms, and cancellation method will be shown before purchase or in a separate order. You authorize us and our payment provider to charge the payment method you provide. Except where required by law or expressly stated at purchase, fees already paid are non-refundable.
Suspension and termination
You may stop using the Service at any time. If account deletion becomes available, you may request deletion through the Service or by contacting us.
We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or possible legal exposure, fail to pay applicable fees, or use the Service in a way that could harm us, other users, or third parties. When reasonable, we will give notice and an opportunity to address the issue. We may act immediately where needed for security, safety, legal compliance, or to prevent ongoing harm.
Sections that by their nature should survive termination—including intellectual-property provisions, disclaimers, liability limits, dispute terms, and accrued payment obligations—will remain in effect.
Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim all express or implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and that the Service will be uninterrupted, secure, accurate, complete, or error-free.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded. You may have additional statutory rights depending on where you live.
Limitation of liability
To the fullest extent permitted by law, Yellow Plus Inc. and its affiliates, officers, employees, agents, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from or related to the Service or these Terms.
To the fullest extent permitted by law, our total liability for all claims arising from or related to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service during the 12 months before the event giving rise to the claim or (b) US$100.
These limitations do not apply to liability that cannot be limited or excluded under applicable law.
Indemnity
If you use the Service on behalf of a business or organization, that organization will defend and indemnify Yellow Plus Inc. and its affiliates, officers, employees, and agents from third-party claims, damages, and reasonable costs arising from Your Content, your unlawful use of the Service, or your material violation of these Terms or another person's rights. This section does not apply to individual consumers where prohibited by law.
Governing law and disputes
Before filing a formal claim, you and air.build agree to try to resolve the dispute informally by sending a written description of the issue and requested resolution. If the dispute is not resolved within 30 days, either party may pursue available legal remedies.
These Terms are governed by the laws applicable to Yellow Plus Inc., without regard to conflict-of-laws rules. Any mandatory consumer protections and rights available in your country or region remain unaffected. A court with competent jurisdiction may hear disputes that cannot be resolved informally.
Changes to these terms
We may update these Terms as the Service or applicable law changes. We will post the revised Terms here and update the date above. If a change materially affects your rights, we will provide additional notice when required. Changes apply prospectively from their effective date. If you do not agree to revised Terms, you must stop using the Service.
General terms
These Terms, the Privacy Policy, and any applicable additional terms are the entire agreement between you and us concerning the Service. If a provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our written consent; we may transfer them as part of a merger, acquisition, reorganization, or sale of assets. These Terms do not create an agency, partnership, joint venture, employment, or third-party beneficiary relationship.
